  1. To Enter: There are two ways to enter: i) An eligible Visa® cardholder will automatically be entered for a chance to win their Visa purchases for the month every time that he/she makes a purchase with his/her individual or business Visa card between November 1, 2008 at 12:00:01 a.m. Eastern Time (ET) and December 31, 2008 at 11:59:59 p.m. ET (the "Contest Period") that is posted to his/her account by the 6th business day of the month following the date of purchase (a "Qualifying Purchase"). In each month of the Contest Period (each "Contest Month"), an eligible Visa cardholder will be automatically entered every time he/she has made a Qualifying Purchase. An eligible Visa cardholder will receive one additional automatic entry ("Bonus Entry") in each Contest Month every time he/she makes a Qualifying Purchase at a participating Banana Republic, Gap, or Old Navy location in Canada. Cash advances, fees (including, without limitation, annual fees, NSF fees, over credit limit fees, etc.), convenience cheque transactions, balance transfers, automated teller machine (ATM) transactions and returns shall not be considered to be Qualifying Purchases. Transactions made during the Contest Month but not posted to the applicable Visa account by the 6th business day of the month following the date of purchase shall not be considered to be Qualifying Purchases. The following are also excluded from being eligible for entry: a) purchases made by an unauthorized user; b) purchases made with Visa cards that are stolen, fraudulent, tampered with, or otherwise altered, and; c) purchases made using Corporate, Purchasing or pre-paid Visa cards. A listing of Visa cardholder purchases made during the Contest Month and posted to a Visa account will be determined by Visa Canada Corporation ("Sponsor"). ii) NO PURCHASE REQUIRED: To enter without being a Visa cardholder or to enter as a Visa cardholder without purchase or obligation, hand-print your name, address, city, province or territory, postal code, day and evening telephone numbers, the Contest Month during the Contest Period for which you want your non-purchase entry entered in, and a 100-word or more handwritten essay on the "Value of having a Visa card", and mail in a postage stamped envelope to: "Visa Win What You Buy", PO Box 4099, Paris Ontario N3L 3W9. Visa cardholders must include the first 8 digits of their Visa account number for verification purposes. Non-purchase entries must be postmarked by the last day of the Contest Month for which you want your non-purchase entry entered and received by the Sponsor by the 6th business day of the month following the Contest Month. No mechanical reproductions permitted. All entries become the property of the Sponsor and will not be returned.
  2. Drawing: A draw will be held at the end of the Contest Period for each Contest Month for the prize awarded for each day of each Contest Month. On January 22, 2009 at 11:00 a.m. PT in Foster City, California, a draw will be held to randomly select one (1) potential winner for each day of the Contest Period (e.g. 30 winners in November and 31 winners in December) from among all eligible entries for each Contest Month of the Contest Period. Maximum of one (1) prize per person for the Contest Period.
  3. Eligibility: To be eligible to win a prize, an entrant must: a) be a Canadian resident; b) be the primary cardholder of a consumer or business Visa card issued by a Canadian Financial Institution ("FI") prior to November 1, 2008 whose card is open and in good standing at the time of verification by the cardholder's FI; c) have reached the age of majority in the province or territory in which she/he resides as of November 1, 2008, and; d) not be an employee of, or living with an employee of, Visa Canada Corporation or its affiliates, Visa Canada licensed financial institutions, Banana Republic, Gap, or Old Navy, Visa Canada's advertising or promotional agencies, or the independent contest judging organization. Contest is void where prohibited or restricted by law. The Contest is subject to all applicable federal, provincial, and local laws and regulations.
  4. Prizes: One prize will be available to be awarded for each day of each Contest Month of the Contest Period (61 prizes in total). Prizes will be awarded in Canadian dollars. Maximum value of each prize (individual prize) is $100,000 (Cdn.). Purchase Winners: Each prize will be awarded as a credit to the primary cardholder's Visa account. Purchase winners will receive the exact amount of total Qualifying Purchases made by the primary cardholder and any secondary cardholders posted to the primary cardholder's Visa account during the Contest Month (less returns posted to that account during the applicable Contest Month) that matches exactly the Visa account that is drawn in the Contest to a maximum of $100,000 (Cdn.). Non-Purchase Entry (mail-in) Winners: Non-purchase entry winners will receive a cheque equal to the largest amount of total Qualifying Purchase transactions made by a purchase winner during the applicable Contest Month.
  5. Odds: The odds of winning a prize for each Contest Month depend on the total number of eligible automatic entries, Bonus Entries and non-purchase entries received.
  6. Use of Information: By using a Visa card to make a Qualifying Purchase during the Contest Period, participants agree to being automatically entered into the Contest and if selected as a potential winner for the Contest, either automatically or by way of non-purchase entry by a Visa cardholder, it will be necessary for the Sponsor to contact the potential winner's FI to award the prize. No permanent records of any such personal information will be retained by such parties, except for the administration of this Contest as set out in Section 10 of these Official Contest Rules. If participating Visa cardholders do not want to be automatically entered into the Contest, they must call 1-800-694-5840 prior to the end of the Contest Period and their Qualifying Purchases will not be entered into this Contest.
  7. Winner Notification/Prize Awards: Selected entrants will be notified via courier or in person by the independent contest judging organization. In order to win any prize, each selected entrant must correctly answer, unaided, a time-limited, arithmetical skill-testing question and sign and return the Sponsor's standard Declaration and Release Form within 22 days from the time the prize notification is postmarked as having been sent by the independent contest judging organization. The arithmetical skill-testing question and the Declaration and Release Form will be included in the prize notification package from the independent contest judging organization. Non-responding selected entrants will be notified by phone at the two primary telephone numbers (as indicated on their Visa account records maintained on their FI's system or as shown on their non-purchase entry) between the 11th and 14th, and 17th and 20th days following the initial notification. No messages will be left and the independent contest judging organization must speak directly to the selected entrant. The prize will be forfeited and awarded to an alternate winner if the prize notification is returned as non-deliverable, if the Declaration and Release Form, including arithmetical skill-testing question, is not returned within 22 days from the time the prize notification package is postmarked as having been sent by the independent contest judging organization, or if the arithmetical skill-testing question is incorrectly answered. In the event the alternate winner does not return the required documentation within 22 days (following the procedures set forth above) or does not correctly answer the arithmetical skill-testing question, the prize will be forfeited and not awarded to any further alternates.
  8. Additional Terms: By participating, entrants agree to a) these Official Contest Rules and the decisions of the independent contest judging organization and the Sponsor which shall be final in all respects; and b) release, discharge, indemnify and hold harmless Visa Canada Corporation, Visa Canada licensed financial institutions (including all FIs), Banana Republic, Gap, Old Navy, each of their respective subsidiaries, affiliates, officers, directors, and employees, including Visa Canada's promotional agencies and the independent contest judging organization, from any liability, claims, damages, demands, actions, or causes of action whatsoever which they, their heirs, successors, assigns, executors, or administrators may now or hereafter have directly or indirectly against them or any of them in respect of or relating to the Contest and/or the acceptance or use, misuse, or possession of any prize. By accepting a prize, winners agree to the Sponsor's and its designees' use of their names, city, province or territory of residence and/or photograph for advertising and publicity purposes without compensation.
  9. Limitation of Liability: The Sponsor, each FI and Banana Republic, Gap and Old Navy shall not be responsible for print or typographical errors in any Contest-related materials; for stolen, lost, late, misdirected, damaged, incomplete, illegible, or postage-due non-purchase entries; or for transactions that are posted late or incorrectly or are lost due to computer or electronic malfunction. The Sponsor reserves the right, subject to the approval of the Régie des alcools, des courses et des jeux du Québec, to cancel or modify the Contest if fraud or technical failures compromise the integrity of the Contest as determined by the Sponsor in its sole discretion.
  10. Privacy Policy: By entering this Contest, you consent to the Sponsor, its promotional agencies, contest administrator, and the independent contest judging organization storing and using the personal information submitted through automatic entry and through non-purchase entry for the purpose of administering the Contest in accordance with these Official Contest rules and the Sponsor's privacy policy at www.visa.ca/privacy.
  11. For Québec Residents Only: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
